Respected Sir,
Kindly refer to my representations dated 08.04.2016 regarding the matter where I brought to your notice several facts related to the 1320 MW thermal power project in Mirzapur for which forest clearance application is submitted by the project proponent M/s Welspun Energy (U.P.) Pvt. Ltd. in your office.
It is to inform you that the ‘Environmental Clearance’ dated 21.08.2014 granted to the project proponent by Ministry of Environment, Forests and Climate Change is quashed by the Hon’ble National Green Tribunal, Principal Bench, New Delhi in its judgment dated 21.12.2016 in the matter ‘Debadityo Sinha & Ors V Union of India & Ors (Appeal no. 79/2014)’. In addition to it, the court has also directed the project proponent M/s Welspun Energy (U.P.) Pvt. Ltd to restore the area.
I am attaching the copy of the judgment for your perusal. The same can be also accessed from the website of the National Green Tribunal by following tab ‘Judgments’ > ‘Principal Bench’ > ‘Court no. II’ > ‘Date’ > 21/December/2016.
In light of the abovementioned proceedings, I request you to kindly reject the application for Forest Clearance as the Environmental Clearance of the project based on which the same was sought has now been set aside.
